1. Scope

These Terms and Conditions apply to all orders placed through the SunnyHillSeeds online shop operated by:

By placing an order, the customer agrees to these Terms and Conditions in the version valid at the time the order is submitted.

These Terms apply to both consumers and business customers unless otherwise expressly stated.

2. Contract Formation

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.

By completing the checkout process and submitting the order, the customer makes a binding offer to purchase the selected products.

After the order has been submitted, the customer may receive an automatically generated acknowledgement of receipt. This confirmation only confirms that the order has been received and does not necessarily constitute acceptance of the purchase contract.

The purchase contract is concluded when we expressly accept the order, confirm its processing or dispatch the goods.

We reserve the right to refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, incorrect pricing, legal restrictions or delivery difficulties.

3. Prices

All prices displayed in the online shop are stated in Euro (€).

Where applicable, prices include statutory value-added tax.

Shipping costs, payment-related charges and any other applicable fees are displayed separately during checkout before the order is submitted.

For deliveries outside the European Union, additional customs duties, import taxes or local charges may apply. These charges are not included in the product price or shipping costs and must be paid by the customer.

4. Payment

The payment methods currently available are displayed during checkout. These may include:

• Bank Transfer
• PayPal
• Bitcoin

We reserve the right to add, remove or restrict individual payment methods.

Unless otherwise agreed, orders are processed and dispatched only after full payment has been received.

The customer is responsible for providing the correct payment reference and completing payment within the specified period.

5. Shipping and Delivery

Orders are shipped to the delivery address provided by the customer during checkout.

The customer is responsible for ensuring that the delivery address is complete and correct. Additional costs resulting from an incorrect, incomplete or undeliverable address may be charged to the customer.

Delivery times stated in the online shop are estimates and may vary depending on the destination country, postal service, customs clearance, weather conditions, seasonal demand or other circumstances outside our control.

6. Seeds and Natural Products

Seeds and other botanical products are natural products. Natural variations in colour, shape, size, appearance and weight do not constitute a defect.

Product photographs are representative illustrations. The appearance of the delivered product may differ slightly from the images shown.

Germination and cultivation success depend on numerous factors outside our control, including storage, soil quality, temperature, moisture, light, climate, pests, watering and cultivation methods.

Unless expressly guaranteed in writing, we therefore cannot guarantee a specific germination rate, plant development, harvest quantity or cultivation result.

7. Product Availability

All products are offered subject to availability.

If a product becomes unavailable after an order has been placed, we will inform the customer as soon as reasonably possible.

Any payment already received for an unavailable product will be refunded. Where appropriate, we may offer a suitable replacement, which the customer is free to accept or decline.

8. Retention of Title

The delivered goods remain the property of Gassner Vertriebs GmbH until the purchase price and all related charges have been paid in full.

9. Warranty and Complaints

Statutory warranty rights under Austrian law remain unaffected.

Customers are requested to inspect the delivery after receipt and to notify us of visible damage, missing items or incorrect products as soon as reasonably possible.

When reporting a problem, customers should provide the order number, a clear description of the issue and, where helpful, photographs of the product and packaging.

Failure to notify us immediately does not limit the statutory rights of consumers.

10. Liability

We are liable without limitation for damage caused intentionally or through gross negligence.

Liability for slight negligence is limited to cases in which essential contractual obligations have been breached and only to the extent permitted by applicable law.

Nothing in these Terms excludes or restricts liability for personal injury, mandatory consumer rights or any other liability that cannot legally be excluded.

We are not responsible for damage caused by improper storage, handling, cultivation or use of the products after delivery.

11. Import and Local Regulations

Customers are responsible for checking whether the ordered products may legally be imported, possessed, stored, cultivated or used in their country or region.

Regulations may vary between countries and may change without notice.

SunnyHillSeeds cannot guarantee that a product permitted in Austria may also be legally imported or cultivated in the customer’s country.

We accept no responsibility for customs delays, inspections, confiscations, destruction of goods, import restrictions, refused deliveries or additional fees imposed by authorities or postal services. Mandatory consumer rights remain unaffected.

12. Right of Withdrawal

Consumers may have a statutory right to withdraw from the purchase contract within the applicable withdrawal period.

Details concerning the withdrawal period, procedure, exceptions and model withdrawal form are provided on our separate Right of Withdrawal page.

Statutory exceptions to the right of withdrawal may apply, particularly to goods that are sealed for reasons of health protection or hygiene and have been unsealed after delivery, as well as to other products excluded by applicable law.

13. Data Protection

Personal data is processed in accordance with applicable data protection law and our Privacy Policy. The Privacy Policy explains which data is collected, how it is used and which rights customers have regarding their personal information.

14. Governing Law

These Terms and the contractual relationship between the customer and Gassner Vertriebs GmbH are governed by the laws of the Republic of Austria.

The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

For consumers, this choice of law does not deprive them of mandatory consumer protection rights granted by the law of their country of habitual residence.

15. Severability

If any provision of these Terms is or becomes invalid, unlawful or unenforceable, the validity of the remaining provisions shall not be affected. Mandatory statutory provisions shall apply in place of the invalid provision.
